In a situation of fragility, the least anyone deserves is to be treated with respect, empathy and dignity. In Portugal, fortunately, patients&#8217; rights are well defined and protected by law, but they are not always known by those who need them most.  <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-864bc02 exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-spacer\" data-id=\"864bc02\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-e770ab4 e-flex e-con-boxed wpr-particle-no wpr-jarallax-no wpr-parallax-no wpr-sticky-section-no e-con e-parent\" data-id=\"e770ab4\" data-element_type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-423e5bd exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-heading\" data-id=\"423e5bd\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What are patients' rights in Portugal?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-58e274d exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"58e274d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>These rights are provided for in <a href=\"https:\/\/diariodarepublica.pt\/dr\/detalhe\/lei\/15-2014-571943\" target=\"_blank\" rel=\"noopener\">Law no. 15\/2014<\/a>, the <a href=\"https:\/\/www.sns.gov.pt\/noticias\/2019\/08\/16\/lei-de-bases-da-saude-2\/\" target=\"_blank\" rel=\"noopener\">Basic Health Law<\/a>, the <strong>Charter of the Rights of the Hospitalized Patient<\/strong>, among other pieces of legislation. Here are the main ones, in simple format: <\/p><p> <\/p><ul><li>Right to dignity, respect and non-discrimination<\/li><li>The right to adequate, timely and quality health care<\/li><li>Right to clear, objective and accessible information on health status<\/li><li>Right to accept or refuse examinations, treatments or interventions<\/li><li>The right to a <a href=\"http:\/\/46.105.61.121\/blog\/saude\/segunda-opiniao-medica\" target=\"_blank\" rel=\"noopener\">second medical opinion<\/a><\/li><li>Right to spiritual and religious assistance<\/li><li>Right to be accompanied by a family member or nominated person<\/li><li>Right to privacy in all clinical acts<\/li><li>Right to confidentiality of clinical and personal data<\/li><li>Right of access to medical records<\/li><li>The right to submit suggestions, complaints or denunciations<\/li><li>Right to continuity of care after hospital discharge<\/li><li>Right to individual freedom, with legal exceptions.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-373af9e exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-heading\" data-id=\"373af9e\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">The Patients' Bill of Rights: what is it?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0f8fd16 exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"0f8fd16\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The famous <strong>Charter of Patients&#8217; Rights<\/strong>, approved by the Ministry of Health, brings together a set of principles that guarantee that every person is respected as a user of the health system. Many of these rights are enshrined in the Constitution of the Portuguese Republic, in the <strong>Basic Law on Health,<\/strong> and in international documents such as the <strong>Charter of Fundamental Rights of the European Union<\/strong>. <\/p><p> <\/p><p>You can consult the version published by the <a href=\"https:\/\/ordemdosmedicos.pt\/files\/pdfs\/UUbb-Carta_dos_Direitos_e_Deveres_dos_Utentes.pdf\" target=\"_blank\" rel=\"noopener\">Portuguese Medical Association<\/a> or on the <a href=\"https:\/\/www.sns24.gov.pt\/guia\/direitos-e-deveres-do-utente\/carta-dos-direitos-de-acesso-aos-cuidados-de-saude-pelos-utentes-do-servico-nacional-de-saude\/\" target=\"_blank\" rel=\"noopener\">SNS24 website<\/a>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f98a100 exad-sticky-section-no exad-glass-effect-no protection<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3778a4a exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"3778a4a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Being hospitalized can be distressing and, for this reason, the <a href=\"https:\/\/www.dgs.pt\/upload\/membro.id\/ficheiros\/i006779.pdf\" target=\"_blank\" rel=\"noopener\">\n  <strong>rights of hospitalized patients<\/strong>\n<\/a> include special care:<\/p><p> <\/p><ul><li>Facilities adapted to patient comfort and well-being<\/li><li>Right to privacy and tranquillity, including during hygiene care or rest<\/li><li>Clear information about hospital services (meals, visits, spiritual support, etc.)<\/li><li>Prohibition of discrimination based on age, gender, ethnicity or religion<\/li><li>The right to visits, whenever the clinical situation allows.<\/li><\/ul><p> <\/p><p>In the case of children, the <a href=\"https:\/\/portal-chsj.min-saude.pt\/utentes-e-visitas\/direitos-e-deveres-dos-utentes\/carta-da-crianca-hospitalizada\" target=\"_blank\" rel=\"noopener\">\n  <strong>Charter for Hospitalized Children<\/strong>\n<\/a>which guarantees, among other things, the continuous presence of parents.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-79e780e exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-spacer\" data-id=\"79e780e\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-element elementor-element-760985f exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"760985f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>People diagnosed with cancer face very specific challenges. The rights of cancer patients include: <\/p><p> <\/p><ul><li>Access to specialized and humanized healthcare<\/li><li>Respect for the patient&#8217;s emotions, fears and decisions<\/li><li>Proper monitoring at all stages of the disease<\/li><li>Psychological and social support<\/li><li>Possibility of receiving palliative care with comfort and dignity<\/li><li>And, in many cases, the <a href=\"http:\/\/46.105.61.121\/blog\/saude\/doentes-oncologicos-tem-direito-a-transporte\" target=\"_blank\" rel=\"noopener\">right to free transportation to treatments<\/a> such as consultations, chemotherapy or radiotherapy, especially when the patient is frail or has no means of travel of their own.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ee3caac exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-heading\" data-id=\"ee3caac\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Rights of the terminally ill patient<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ca9115a exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"ca9115a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>When a patient is terminally ill, the focus becomes comfort, well-being and respect for their wishes.<\/p><p> <\/p><p>The rights of the terminally ill patient include:<\/p><p> <\/p><ul><li>Receive adequate palliative care<\/li><li>Be accompanied by whoever you want<\/li><li>Control over treatment decisions<\/li><li>The right to tranquillity, privacy and a welcoming environment.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f948a49 exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-heading\" data-id=\"f948a49\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Informed consent: what it is and when it is mandatory<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5501180 exad-sticky-section-no exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"5501180\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Informed consent<\/strong> is the patient&#8217;s right to make a free and informed decision about what is going to be done to them. There may be mistakes, misunderstandings or situations in which the patient feels disrespected, ignored or mistreated. If this happens to you or someone close to you<strong>, don&#8217;t be afraid to take action.<\/strong> Complaining is not being annoying. <strong>It&#8217;s exercising a right.<\/strong> It&#8217;s contributing to a fairer, more humane and more efficient health system.  <\/p><p> <\/p><p>Here are the steps you can take calmly and confidently:<\/p><p> <\/p><ol><li><strong>Talk to the person who attended you first<\/strong>. Sometimes all it takes is a conversation with the healthcare professional or the person in charge of the service to clarify the problem <\/li><li>If it doesn&#8217;t work, <a href=\"https:\/\/www.livroreclamacoes.pt\" target=\"_blank\" rel=\"noopener\"><strong>fill in the Complaints Booklet<\/strong>,<\/a> available in physical format, on site, or online<\/li><li>You can also go to the <strong>User&#8217;s<\/strong> (or Citizen&#8217;s) <strong>Office<\/strong> at the hospital or health center. They are there to listen to you <\/li><li>If the situation is more serious or is not resolved, you can complain directly to the <a href=\"https:\/\/www.ers.pt\" target=\"_blank\" rel=\"noopener\">Health Regulatory Authority (ERS)<\/a><\/li><li>And if you really are facing an unfair situation with serious consequences, you can go <strong>to court<\/strong>, with legal support.<\/li><\/ol><p> <\/p><p>If you need help or don&#8217;t know where to start, you can also call <strong>\n  <a href=\"https:\/\/www.deco.proteste.pt\/info\/os-nossos-servicos\/contactos\/saude\" target=\"_blank\" rel=\"noopener\">DECO PROTeste<\/a>\n<\/strong>which provides consumer support in the health area: 808 780 250 (landline) or 218 418 783.<\/p><p> <\/p><p><strong>Remember:<\/strong> complaining is also taking care of yourself and others.
